1. Terms of Service
These Terms of Service ("Terms") govern your use of buildmode.studio (the "Site") and any inquiry or booking made through it, operated by Buildmode Studio ("Studio," "we," "us," or "our"), operating under Buildmode Digital Inc., based in London, Ontario, Canada.
By visiting the Site or submitting an inquiry, you agree to these Terms.
2. Pre-Launch Status
Buildmode Studio is currently pre-launch. We are not yet accepting paid bookings — the Site exists to share information about planned services and to build a founding-client list. Founding-client pricing shown on the Site (e.g. The Flyby founding rate) is honoured for founding-list members when booking opens, subject to the written service agreement described below.
- Joining the founding-client list is free and does not create a contract or obligation to purchase services.
- No service is rendered, and no fee is owed, until both parties sign a separate written service agreement specific to that project.
- Service availability depends on completion of required licensing (see Section 3 below).
3. Services
Buildmode Studio plans to offer video production services for contractors and trades businesses, including FPV (first-person-view) drone flythroughs and project documentation. Specific services, pricing, and scope will be defined in a written agreement for each booking once we are accepting clients.
4. Drone Operations & Regulatory Compliance
Drone (RPAS) operations in Canada are regulated by Transport Canada. The required pilot certification (Advanced RPAS) is in place. Drone-based services will only be offered once applicable insurance and any operational authorizations are also in place.
- All flights will be conducted in compliance with applicable Transport Canada rules, including airspace restrictions, altitude limits, and any required notifications or authorizations for the specific site.
- Clients are responsible for disclosing any site-specific hazards or restricted airspace conditions they're aware of (e.g., proximity to airports, power lines, or restricted zones) prior to a booked flight.
- We reserve the right to decline or reschedule a flight for safety, weather, or regulatory reasons.
5. Liability & Insurance
Liability insurance for drone operations will be held by Buildmode Digital Inc. and will be in place before any paid booking is accepted. A Certificate of Insurance is provided before shoot day as part of any service agreement.
To the fullest extent permitted by law, our liability for any claim related to services will be limited to the amount paid for that specific booking, and we will not be liable for indirect, incidental, or consequential damages.
6. Intellectual Property & Footage Use
Ownership and usage rights for footage and final deliverables (who can use the video, for what, and whether Buildmode Studio can use it in a portfolio or on social media) will be defined per-project in the written service agreement at time of booking. Until that agreement exists, no footage-related rights are implied by visiting this Site or joining the founding-client list.
7. Governing Law & Changes to These Terms
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
We may update these Terms from time to time, including as Buildmode Studio's entity structure and licensing status change. We'll update the "Last updated" date above when we do.
8. Privacy Policy
This section explains what information we collect through the Site, how we use it, and your rights regarding it.
8.1 What We Collect
- Email address (and name, if provided) — when you join the founding-client list or submit an inquiry.
- Project details you share with us — if you describe a project or job site when reaching out, e.g., via studio@buildmode.ca.
- Basic technical data — standard web server logs collected automatically by our hosting provider for security and performance purposes.
8.2 How We Use It
- To notify you when booking opens, if you've joined the founding-client list
- To respond to your inquiry and scope a potential project
- To meet legal, accounting, or security obligations
We do not sell your personal information to third parties. We use a small number of service providers (such as our email and hosting providers) to operate the Site; they only receive the data needed to perform that function.
8.3 Your Rights & Choices
- Unsubscribe from the founding-client list at any time using the link in any email we send, or by contacting us.
- Request a copy of the personal information we hold about you.
- Request deletion of your personal information, subject to records we're legally required to keep.
- Correct inaccurate information by contacting us directly.
The Site is not directed at children, and we do not knowingly collect personal information from anyone under 16.
We may update this Privacy Policy from time to time; the "Last updated" date above reflects the most recent version.
